Freight Forwarder vs. Carrier

Unlike a carrier, a freight forwarder also handles administrative tasks, transport planning, and coordination between all involved parties. According to Dutch law, Article 8:60 of the Civil Code (BW) states:
"The agreement for the transportation of goods is the agreement whereby one party (the freight forwarder) undertakes to conclude one or more agreements on behalf of the other party (the client) for the transport of goods, or to make a provision in such agreements, on behalf of the client."

Is a Freight Forwarder Liable for Transport?

If goods are stolen, damaged, or delayed during transport, the freight forwarder is not liable, as their role is to organize the transport, not carry it out. The liability of the freight forwarder is limited to 10,000 SDR per incident or series of incidents with the same cause.

In cases of damage, depreciation, or loss of goods, liability is further limited to 4 SDR per kilogram of gross weight that is damaged, depreciated, or lost. Freightwatch can arrange additional transport insurance if necessary.

Claims under Article 23, Paragraph 1 of the Dutch Forwarding Conditions will be settled exclusively by the competent Dutch court in the jurisdiction where Freightwatch Benelux BV is located.
